These Terms of Service govern your use of the ARKPIA platform operated by J&JOHN Corp. By accessing or using ARKPIA, you agree to be bound by these terms. Please read them carefully before registering or transacting.
1. Platform Overview
ARKPIA is a physical art authentication and commerce platform that provides:
SHA-256 based artwork fingerprinting and Certificate of Authenticity (COA) issuance
OwnershipChain — a tamper-evident provenance record for physical artworks
Public verification via unique /verify URLs
Marketplace for buying and selling verified physical artworks
Soft Close auction system
SHOP for artist-affiliated goods
2. Eligibility and Registration
To use ARKPIA you must:
Be at least 18 years of age
Provide accurate and complete registration information
Complete applicable KYC verification before transacting
Not be subject to applicable trade sanctions or restrictions
Artist Registration: All artist applications are individually reviewed. Approval is at ARKPIA's sole discretion. Approval does not guarantee any specific level of exposure or sales.
Collector Registration: Collectors may browse freely. KYC verification is required upon first purchase.
3. Artwork Registration and Authentication
Artists warrant that they are the sole creator and rightful owner of all artworks registered
ARKPIA generates a SHA-256 dual-hash fingerprint upon approval — this creates a tamper-evident digital record, not a legal guarantee of authenticity
The OwnershipChain record is created upon delivery confirmation, not at the time of payment
ARKPIA reserves the right to reject or remove artworks that violate platform standards or applicable law
Each registered artwork receives a unique ARKPIA Serial (ARK-YYYY-XXXXX) and public /verify URL
4. Transactions and Payment
Payment Methods: Bank wire transfer is the primary payment method for art transactions. Card payments are also supported for eligible transactions. Payment credentials are processed by authorized third-party payment providers.
Card Payment Limits: Card payments may be limited by transaction amount, transaction type, or compliance review. Under current platform policy, higher-value transactions, including transactions above $3,500 USD, may be routed to bank wire transfer.
Payment Matching: Invoice name and payment name must match exactly. Third-party payments (payment by someone other than the registered account holder) are prohibited as a risk management measure. Exceptions require enhanced due diligence documentation.
Wire Transfer Deadline: Payment must be received within approximately 5 calendar days (120 hours) of order placement. Orders unpaid within this period may be cancelled.
Ownership Transfer: Ownership of an artwork transfers only after physical delivery is confirmed by the buyer. Payment does not constitute ownership transfer. The OwnershipChain record is updated upon confirmed delivery.
5. Resale Royalties
The original artist receives a 2% resale royalty on all verified resales processed through ARKPIA
This rate applies uniformly regardless of membership tier or sale price
Royalties are calculated on the final sale price and automatically allocated at settlement
Royalties apply only to resales conducted through the ARKPIA platform
6. Cancellation and Returns
Fixed-Price Artworks: Once the payment period has passed and the order is confirmed, sales of fixed-price artworks are final except where otherwise required by law or approved by ARKPIA through a documented dispute review.
Auction Sales: Auction wins are Final Sale and cannot be cancelled except where otherwise required by law.
SHOP Orders: Cancellation is permitted within 24 hours of payment under current policy. Requests must be submitted through the platform.
Disputes: In cases of material discrepancy between the listed and delivered artwork, buyers must contact ARKPIA within 48 hours of delivery confirmation. ARKPIA will review the case and may facilitate dispute resolution at its discretion.
7. VIP Collector Status
VIP Collector status is automatically granted when cumulative purchases reach $20,000 USD
VIP Collectors may receive early access notifications for high-value works up to 48 hours before general availability
VIP status is based on platform purchase history and is non-transferable
8. Selected Artists Program
The inaugural Selected Artists cohort (up to 50 artists) may receive:
PRO or ELITE-level platform features at no cost during the designated period
Priority placement on the homepage and curated exhibitions
Joint launch promotion participation
Corporate and K-Culture collaboration planning opportunities
Monthly ArtPack credit at no charge
Benefits are provided at ARKPIA's discretion and are subject to change with reasonable notice. Benefits are personal to the approved artist and non-transferable.
9. Non-Exclusivity
ARKPIA does not require exclusivity from registered artists. Artists may sell their works through galleries, art fairs, and other channels simultaneously. Works sold off-platform may be connected to ARKPIA's OwnershipChain through the External Sale process subject to seller approval.
10. Prohibited Conduct
Registering artworks you did not create or do not have the right to sell
Submitting false or misleading information in any form
Attempting to manipulate SHA-256 fingerprints or OwnershipChain records
Using the platform for money laundering or any unlawful purpose
Interfering with platform security, integrity, or other users' accounts
Circumventing identity verification requirements
11. Limitation of Liability
ARKPIA provides a platform and infrastructure for art authentication and commerce. We do not guarantee:
The financial value or future appreciation of any artwork
Continuous, uninterrupted access to the platform
The legal title or ownership validity of externally registered works
To the maximum extent permitted by law, J&JOHN Corp.'s liability is limited to the fees paid by the user in the 12 months preceding the claim.
12. Governing Law
These Terms are governed by the laws of the Republic of Korea. Disputes shall be resolved through the competent courts of Seoul, Korea, unless otherwise required by applicable consumer protection law.
13. Changes to Terms
ARKPIA may modify these Terms at any time. Registered users will be notified of material changes via email at least 14 days before they take effect. Continued use of the platform constitutes acceptance.
